Puppy Contract
This Puppy Contract (herein referred to as “Contract”) is made effective as of , 2011, by and between Becky Rivera, Joseph Kaneakalau & Bully Boss Kennels (herein referred to as “BBK”) & ______________________________________________________ (herein referred to as “Buyer”) for the purchase of one (1) [___________________________________________] (herein referred to as “Puppy”).
BBK will make every effort to provide our clients with a healthy, energetic, outgoing, happy, playful, brave, powerful, gentle and well balanced Puppy. Our puppies are raised in our home in a family environment.
TERMS AND CONDITIONS
1. VETERINARY CONSULT. Your Puppy will be current on all shots, heartworm pills and de-wormed appropriate to their age at the time of sale/delivery. Buyer agrees to have a licensed veterinarian check the health of the Puppy within 24 hours of receiving Puppy to verify the Puppy’s state of health. Any problems must be brought to seller's attention within 24 hours of sale. If, within the 24 hours of sale, it is determined by a licensed veterinarian that the Puppy has a life threatening illness, the cause of which is directly attributable to the breeder, the buyer may return the Puppy at their own expense and will receive a full refund of the purchase price. BBK will not be responsible for any veterinary fees. A full written diagnosis from the buyer’s veterinarian must be supplied to BBK prior to the buyer receiving any refunds. BBK reserves the right to have a second diagnosis.
2. NOTICE. If the Puppy develops a life threatening genetic illness or condition before the age of 6 months BBK must be notified immediately. The buyer must provide us with a written statement from a licensed veterinarian containing the diagnosis and prognosis for the Puppy. If this illness or condition results in the Puppy’s death or is not treatable, we will replace the Puppy with another of the buyer's choice from a BBK breeding, based on availability.
3. RESPONSIBILITY. Shots and de-worming, including Heart Worm and any veterinary fees are the responsibility of the buyer after the Puppy is in their possession. If a Puppy develops an illness related to lack of shots and/or de-worming that is the buyer’s responsibility and the Puppy will not be replaced or refunded for any reason.
4. ILLNESSES. If the Puppy develops an easily treated condition at anytime during its life it is not BBKs responsibility. We do not guarantee that your Puppy will never have health problems. We hope that this is not the case and that your Puppy will live a long, happy and healthy life. No refunds will be made for a Puppy with an easily treatable illness.
5. SKIN/COAT PROBLEMS. You, the Buyer should be aware that the blue coat coloring in most breeds is associated with skin problems. Blue coated dogs of all breeds are more prone to bacterial, viral, staph and fungal infections as well as various forms of dermatitis, allergies, demodex and color mutant alopecia. While some of these conditions are hereditary many of them are simply the result of the blue coat coloring. Dogs of other coat colors are also prone to these conditions. Therefore, we do not guarantee against any skin or coat problems with the dogs produced by BBK. Most of these problems are easily treated by a veterinarian. Not all blue coated dogs will be affected by this, but you must be prepared to treat your dog if necessary. We will not replace a dog or make any refund on a dog purchased from us that has skin or coat problems as described above.
6. DEPOSIT. When placing a deposit, please note that we do not guarantee any color, or color pattern will be produced in any litter. We do not specialize in any specific color or color pattern. Deposits are not refundable or transferable for any reason having to do with coloring or color patterns. When putting a deposit down on a puppy, please note that picks are set up in order we receive deposits, because of this we recommend sending deposits as soon as possible to ensure your pick will be held, but this is not a guarantee as we feel first come first serve is the fairest way to go.
7. BBK’S RIGHTS. BBK reserves the right to keep any puppy produced. Buyer's puppy selections will not be confirmed prior to puppy reaching 7 weeks of age. All deposits and payments toward any puppy or pick are non-refundable, but transferable to another BBK litter due to the following:
A. If there are not enough of the sex you have requested.
B. Not enough puppies in a litter to cover your pick.
C. Puppy chosen dies or develops a health problem before you receive it.
8. PAYMENT. The full purchase price of the Puppy or Puppy pick must be received by BBK no later than when the Puppy reaches 7 weeks of age. If for any reason the Buyer fails to pay out the balance of a pick by the time the Puppy is 7 weeks of age you must notify us to set up other arrangements. If you fail to do so, no monies will be returned or refunded. Instead it will be credited to the buyer to use at a later date and the Puppy pick will be put back up for sale. To make payments, we accept Pay Pal, Postal Money Orders, Cashier’s Checks and Western Union. Please no personal checks. For our mailing information, please contact us.
9. SHIPPING. Puppies can be picked up or shipped out at the age of 8 weeks old provided they are paid in full. If shipping is needed, BBK will not be responsible for shipping costs. Shipping costs are the sole responsibility of the Buyer. There will be a handling fee of $200 for any Puppy shipped by the breeder. The $200 handling fee covers the cost of a crate to ship the Puppy to you, a health certificate from a certified veterinarian, and transportation fees.
10. CONDUCT. Buyer agrees that said Puppy will not be used for any inhumane, immoral or illegal purposes.
11. PUPPY REGISTRATION. Buyer will receive both UKC and ABKC registration papers for their Puppy. Buyer understands that the registration papers may not be available at the time they pick up or receive their Puppy, due to there often being a delay with mailing from UKC or ABKC. Breeder reserves the right and Buyer agrees that the word "BBK" will be in the Puppy's registration name. Unless otherwise agreed, when purchasing a puppy on a “no breed, spay/neuter contract at discounted price” UKC and ABKC registration will not be furnished.
OPTIONAL NO BREED, SPAY/NEUTER CONTRACT AT DISCOUNTED PRICE
¨ ENTER CHECK MARK IN BOX IF THIS IS A “NO BREED, SPAY/NEUTER CONTRACT AT DISCOUNTED PRICE” CONTRACT.
1. Buyer agrees to purchase BBK pup at a discounted price with the understanding that the said Puppy must be spayed/neutered by the age of 9 months and must not be used for breeding at anytime prior to being spayed/neutered.
2. ABKC/UKC registration papers will be furnished upon receipt of spay/neuter certificate from a licensed veterinarian.
3. Should said Puppy be used for breeding and not spayed/neutered as outlined in this contract, Buyer will not receive UKC/ABKC registration papers for said Puppy at any time regardless if the Puppy is spayed/neutered after the fact.
4. Buyer agrees not to disclose the amount of sale.
OPTIONAL CO-OWN CONTRACT AT DISCOUNTED PRICE
¨ ENTER CHECK MARK IN BOX IF THIS IS A “CO-OWN CONTRACT AT DISCOUNTED PRICE” CONTRACT.
1. Buyer agrees to purchase BBK pup at a discounted price with the understanding that the said Puppy must be co-owned with a BBK representative on ABKC and UKC registration papers.
2. Buyer agrees to not breed said Puppy without discussing with and receiving approval from BBK.
3. BBK will not be able to breed said Puppy without discussing with and receiving approval from Buyer.
4. Buyer will be solely responsible for all vet bills while said Puppy is in Buyers possession.
5. If you are no longer able to care for said Puppy, Puppy must be returned to BBK and no refunds will be given.
6. Buyer agrees not to disclose the amount of sale.
ADDITIONAL INFORMATION AND RECOMMENDATIONS
Be sure to give your Puppy/dog daily exercise, a well balanced diet, positive discipline, lots of affection and plenty of socialization and you will develop a well balanced pet and best friend.
If you are located on theisland of Kauai, we strongly recommend registering your Puppy/dog in the Puppy or Novice obedience classes offered by Dog Fanciers of Kauai. Classes are held twice a year at the Grove Farm Park in Puhi. If, at any time during the Puppy/dog’s life, you are no longer able to care for said Puppy/dog, BBK asks that you return the Puppy/dog to BBK at your own expense. We do not want to see our offspring in Humane Societies or in Pit Bull Rescue Shelters!

PUPPY HAS BEEN CHECKED BY A LICENSED VETERINARIAN AND HAS BEEN FOUND TO BE FREE OF GENETIC DEFECTS AND IS IN GOOD HEALTH. CUSTOMER WILL HAVE THEIR STATE LICENSED VETERINARIAN CHECK THE HEALTH OF THE PUPPY WITHIN 24 HOURS TO VERIFY THE PUP'S STATE OF HEALTH.
